for My Hub Solution

Introduction & Acceptance

By accessing our website or engaging My Hub Solution Enterprise (Registration No: 202403284352 (AS0486369-U)) for any digital marketing services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must discontinue the use of our website and services.

Services Provided

My Hub Solution provides virtual digital marketing services, including but not limited to Search Engine Optimization (SEO), Social Media Marketing, Conversion Rate Optimization (CRO), Marketplace & E-commerce Management, and Email Marketing. Specific deliverables, timelines, and costs will be outlined in a separate Statement of Work (SOW), proposal, or quotation provided to the client.

Payment Terms

  • All fees for services are outlined in the client SOW or invoice.
  • Unless otherwise agreed in writing, payments are due upon receipt of the invoice.
  • My Hub Solution reserves the right to pause or suspend services, ad campaigns, or website hosting if payments are not made within the agreed timeframe.
  • All initial deposits and setup fees are non-refundable.

Client Responsibilities

To ensure the successful and timely delivery of our services, clients agree to:

  • Provide necessary administrative access to platforms (e.g., website CMS, Google Analytics, social media accounts, marketplace seller centers).
  • Provide necessary branding materials, product assets, and approvals in a timely manner.
  • Ensure all images, videos, and text provided to My Hub Solution do not infringe on any third-party intellectual property rights or copyright laws.

Intellectual Property

Upon full payment of all outstanding invoices, the client will own the final deliverables created specifically for them (such as custom ad creatives, written copy, and reports). My Hub Solution retains all rights to its pre-existing proprietary tools, software, backend code, methodologies, and internal marketing strategies.

Warranties and Limitation of Liability

  • No Guarantees on Third-Party Platforms: While we utilize industry-leading practices, My Hub Solution cannot guarantee specific search engine rankings, exact sales volumes, or specific Return on Investment (ROI). Digital marketing relies heavily on third-party algorithms (e.g., Google, Meta, Shopee, TikTok) and market fluctuations which are beyond our direct control.
  • Limitation of Liability: In no event shall My Hub Solution, its directors, or employees be liable for any indirect, incidental, or consequential damages (including loss of profits, data, or business interruptions) arising from the use of our services or website.

Confidentiality

Both parties agree to keep all proprietary information, business strategies, pricing, and sensitive client data confidential. Neither party will disclose this information to any third parties without prior written consent, except as required by law.

Termination

Either party may terminate the working agreement with a standard 30-day written notice, unless a different term is specifically outlined in your SOW. Upon termination, the client is responsible for payment for all work completed and expenses incurred up to the date of termination.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Updates to these Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on this page, and your continued use of our website or services constitutes acceptance of those changes.
